Oregon Constitution vs. US Constitution

New laws in Oregon

  • Bystanders have the explicit right to film police officers while they perform their duties
  • The words "husband and wife" have been replaced with "spouses in a legal marriage"
  • Oregon's 1o,000 domestic workers (mostly women and immigrants) will receive workplace rights such as overtime pay, rest periods and paid personal leave.
  • Rape victims will have 12 years instead of six years to report an attack before statute of limitations expires.
  • Oregonians driving a non-commercial vehicle will be allowed to pump their own gas -as long as they stop at a service station in a rural area

Oregon voters have the ability to recall state and local officials. American voters are not able to recall anyone during their term.

Oregonians are able to make their own laws by the initiative system. While the people do not have the power to make federal laws under the US Constitution.

Members of the US Congress have much more ability to tax and spend while Oregon legislators are limited by the state constitution on money matters.

When is comes to Oregon's protection of a military body, our main state of defense is the Oregon State of Defense Force (ORSDF) and the other two components are Oregon's Army and Air National Guard. The ORSDF serves under the Governor of Or. rather than the President of the US.

State constitutions usually differ fro the US Constitution because state constitutions tend to be much longer and more detailed. Also state constitutions focus mostly on limiting rather than granting power since the US Constitution is considered "the Supreme Law of the Land". Not only that, but state constitutions bring forth topics that matter only for their territory and are open to adding more amendments.

  • The Oregon Constitution was framed by a convention of 60 delegates chosen by the people
  • Met on the third Monday in August 1857 and adjourned on September 18, 1857
  • On February 14, 1859 our Constitution went into effect and Oregon was accepted into the Union

The Oregon Constitution is similar to the US Constitution in the matters of individual liberties because both constitutions share the same rights such as : freedom of religion, freedom of speech and press, right to bear arms, quartering troops, right to a jury trial and unreasonable search and seizure.
