Basically anyone with a heart felt bad for the indians they were being kicked off of their land and told to shoo.

Some Georgians thought if we got

them off our land then we would have more useful space not just wasted space

People thought wow! do we really dislike the native americans that much that we don't want them to have the same beliefs as us and for them to prosper.

A little amount of people thought you're american why be against your nationality, instead of helping native americans help some drunk bums who don't care.

Supreme Court Decision

The court said that the Cherokee Nation did not possess original jurisdiction because the tribe was not a state.

People thought that Georgia was cruel in regards to the treatment of the Native americans. And the supreme courts got them angrier because they said that since they weren't a state they couldnt go to court. So Georgia got even more power.

Worcester Vs. Georgia

was a case that the Supreme Court vacated the conviction of Samuel Worcester and said that Georgia had a criminal statute that prohibited non-Indians from being present on Indian lands without a license from the state was unconstitutional.

denied the right of the Cherokee to bring a suit against the state. However, a year later, in a more properly formulated case, Worcester v. Georgia, the court ruled that the laws of Georgia were invalid in Cherokee land.

BACKGROUND:

Georgia created a law to remove Cherokee from all of their historic lands

The Cherokee Nation was seeking a federal injunction against laws that were passed by the state of Georgia.

*He was doing something positive

* that the state could not maintain the prosecution because the statute violated the Constitution

*He didn't have a license

*He had to take the oath to support and defend the constitution and laws of the state of Georgia which he didn't.

Worcester vs. Georgia

deprived the Cherokee Nation of receiving basic human rights within their own tribal boundaries.

These laws were very hateful

The court ruled that the Cherokee nation was a "distinct community" with self-government in which the laws of Georgia can have no force, which led to the establishment that the national government had authority in Indian affairs, not individual states.

They were using historical lands that could bring in revenue

Both of these cases matter because they led toward the Trail of Tears and showed the country the wrongs that these innocent people faced for basically living

They are similar because the both have to do with infractions of Native americans rights in Georgia.
