ASYLUM

" The asylum process aims to establish whether the asylum seeker is eligible for refugee or protected status and whether the non-refoulement principle applies. "
REFUGEE
" Any person may be recognized as refugee who suffered from persecution in his/her country of origin for reasons of race, religion, nationality, membership of a particular social group, or political opinion; and who currently stays in the territory of Hungary and has applied for a refugee status. "

"For the protection of the human rights and fundamental freedoms of those compelled to leave their countries,
with regard to the international obligations of Hungary and the generally recognised basic principles of international law,
bearing in mind the European Union’s refugee policy and the interest in the creation of an area which is based on freedom, security and the enforcement of law,
respecting the national traditions of migration and the spirit of welcome of the international community,
recognising and supporting the activities of the unions which play a part in assisting those benefiting from protection,
Parliament hereby adopts the following Act on Asylum."

Hungarian citizenship may be attested by means of:
• a valid Hungarian identity card,
• a valid Hungarian passport,
• a valid citizenship certificate,
• a certificate of naturalization – until proven otherwise.
Verification of citizenship ex officio:
By virtue of Act LV of 1993 on Hungarian citizenship, Section 12, the Hungarian and foreign authorities may verify a person's Hungarian citizenship status ex officio, if it is necessary in a case processed by them.
This may occur in such cases as the pre-marital registration procedure, national registration, submission of application for passport and in alien policing procedures.

In the asylum process the following decisions may be made on the merits of the application:
- granted refugee status;
- granted subsidiary protection status;
- granted “tolerated stay” status which enables the asylum seeker to provisionally stay in Hungary;
- application is fully rejected;
During the preliminary examination the authority will assess the following:
- whether you are a citizen of another EU member state;
- whether you are recognized as a refugee by another state;
- the reasons provided, in the case of repeated application;
- whether there is any country other than your home country which can be regarded as a safe third country
