Case #1

Why?

How?

  • To compete with Uber

Edmonton (City) v Uber Canada Inc, 2015 ABQB 214 (CanLII)

  • 10 point plan
  • Free gum, free roses on V-Day
  • No refusal of rides
  • No phone calls
  • No politics

FACTS:

  • Edmonton, Alberta (April 1st, 2015)
  • City of Edmonton accusing Uber Canada of conducting business in the City of Edmonton without a valid business license or Taxi Broker License under the Vehicle for Hire Bylaw 14700 and Business License Bylaw 13138

ISSUES:

  • Has the City established that Uber Canada Inc has engaged in activities that are in clear and continuous breach of the referenced Bylaws?

DECISION:

  • Uber Canada won
  • Evidentiary gap concerning the known involvement of the other participants in that service
  • The City failed to prove a clear and continuing breach of the bylaws by Uber Canada

Case #2

R v Sandhu, 2015 ABQB 827 (CanLII)

FACTS:

  • Edmonton, Alberta (January 7th, 2015)
  • Barinder Sandhu charged with violating Bylaw 13138 and 14700

Denis Coderre- Mayor of Montreal

ISSUES:

  • On the day in question, was Mr. Sandhu operating a business without a license or operating a vehicle for hire without a license?
  • Opposed to Uber
  • Montreal's City Taxi Bureau
  • Seizing Uber cars
  • Wrong side of public opinion

DECISION:

  • The Judge allowed the appeal and ordered a new trial
  • Believed the trial was not unfair seeing as though Mr. Sandhu originally brought up Uber in his statement, therefore eliminating his argument of being surprised that Uber was brought up

What is the issue?

John Tory- Mayor of Toronto

"Right now if they don't respect the rules, yes it's illegal, of course it's illegal,"

"The problem with Uber is that it's illegal transportation"

  • Believes impractical to shut Uber down
  • Not doing much for Taxis
  • Against increase in licensing fees
