The Law of republic of Kazakhstan “About copyright and neighboring rights”
It was adopted in 10 of July in 1996 and consists of 5 chapters and 17 articles.
Chapter1. General provisions.
Article 1.
The present Law regulates relations in the field of intellectual property, arising in connection with the creation and use of works of science, literature and art (copyright), performances, performances, broadcasts of organizations of on-air and cable broadcasting (related rights).
Article 2. Basic concepts used in this Law
1.The author is a natural person, who created a work of science, literature, and art with the help of its creative work.
2.The copyright is a personal non-property and property rights of the author.
3.Technical means of protection of copyright and related rights, technical device or its components
Article 3. The legislation of the Republic of Kazakhstan on copyright and allied rights
The legislation of the Republic of Kazakhstan on copyright and related rights consists of the Civil code of the Republic of Kazakhstan, this Law was published in accordance with other normative acts.
The policy of the intellectual property.
The aim of the strategy of the Republic of Kazakhstan (RK) in the field of protection of intellectual property rights consist of the three directions:
1. Bringing the legal regime for the management of intellectual property rights in compliance with international standards
2. Providing in practice the execution of a legal regime for the management of intellectual property rights
3. Training of highly qualified specialists in each separate sphere of intellectual property protection.
The authorities responsible for the management of intellectual property rights.
The Committee on the rights of the intellectual property of the Ministry of justice of the Republic of Kazakhstan (further - Committee) was established by the resolution of the Government of the Republic of Kazakhstan dated March 29, 2001, N 411 "Issues of the Committee on the rights of the intellectual property of the Ministry of justice of the Republic of Kazakhstan".
