Suspects: Alan Faulkner

Associated with Naismith for a reason no one knows. Worked as the accessory in the murder. Died 3 years later.

Letter saying "Be warned your next" found out the front of Naismiths property the night of the fire.

Blanket laid lengthways in Naismiths garage doused in petrol.

3 5L petrol containers found in the blaze.

Spalling of the concrete on the floor of the garage meaning that peetrol had been poured all over the ground wand overheated the concrete which made the concrete crack and melt

Evidence found around Kevin Naismiths property;

-2 fired 22 caliber cartridge casings found inside the burnt garage

-5 small holes in the rear fibrous garage wall

-A large tree in the property behind Naismiths had lead projectile in it from a 22 caliber bullet

-Frost safe containing 2 22 caliber super X bullets of which one had been fired and the other hadnt

-Blood matching the blood of Mark Banks underneath a plastic bag hidden in Naismiths lounge room.

After searching Alan Faulkners house police found;

-10 glad wrap bags filled with 500g of Cannabis

-2 rounds of ammunition for a 22 caliber gun

-Clothes matching the neighbours description of what the man was wearing at Naismiths house

Evidence found at the burial site in Stockton beach;

-Tooheys beer cap

-Cigarette butt which from later examination had Naismiths DNA on it

-2 incinerated bodies which were Wasley's and Banks'

After the prosecution Naismith said he did it because he was swindled in a drug deal by the two victims.

Evidence

Kevin Naismith was best friends with Danny Wasley for 25 years. They were both the same age (34). When he was first questioned by police he was disgusted that the police would think he would do such a thing. To try and get the police to focus attention away from him, he set fire to his own garage and then wrote a letter saying "Be warned, youre next" on it and placed it outside his house.

$4960 in cash found in a plastic bag in the back of Danny Wasley's red Ford Falcon ute.

Danny Wasley's 1990 red Ford Falcon XF ute and Mark Banks' 1995 blue Hyundai Lantra - When the police found these two cars in the same area the police started to think that this case may be more than just a dual disappearance.

Mark Banks was a married man with one son. He was due to appear in court the day after he was reported missing after he was caught selling a large amount of Marijuana. Banks was preparing to serve a sentence and then come out of jail and turn his life around to become a respectable father. Marks car was found second after also being reported missing. From a drug dealers perspective Banks was known as a mid level dealer.

Next Door neighbours (Provided all the information of what they saw in lots of detail)- Wrote every detail of what they saw because they thought that it might be a good idea to write down after they watched a tv show where they saw it.

Noma Simpson (Another Neighbour)- heard the banging and gunshots when Banks got shot and Wasley got beaten to death.

Naismith:

When Naismith was interviewed he denied absoloutely everything and seeked as much help as he could through solicitors. He ws disgusted that the police would think that he might have killed his best mate of 25 years.

Convictions and Sentencing

When Faulkner was interviewed at first he denied everything but as he got further into the case he got scared of conviction and ended up calling the police the morning of his court hearing and told them where the bodies were and his story of what happened to Danny Wasley and Mark Banks.

A man matching Danny Wasleys description entered Naismiths garage with Naismith the day before the fire and they were heard shouting at each other by Naismith next door neighbours. Naismith soon left the garage to go into his house and when he returned, he was wearing different clothes and had also brought another male with him. The other male was suspected to be Alan Faulkner. According to witnesses, Faulkner had been spotted at Naismith house on many prior occasions. 30 minutes after Faulkner arrived, Mark Banks arrived. Mark Banks entered the house but the next door neighbours never saw Banks or Wasley leave the house again. Later that afternoon Faulkner was spotted driving Danny Wasleys car and Alan Faulkners car with socks on his hands to the parking spots were they were located when reported missing. Faulkner appeared to be wearing different clothes when he drove each car. He also seemed to be struggling to drive the cars which indicated that he had never driven the cars before.

Danny Wasley was a married father of 2 kids. He lived in the Newcastle suburbs. He was associated with the other victim (Mark Banks) through selling marijuana. He was best friends with the suspect for 25 years and were brothers in the suspects mind. Approximately 34 years old. He was last heard yelling "Please Kev, dont do it", referring to Kevin Naismith preparing to shoot Wasley. Danny's car was the first to be found missing after his wife and kids were worried about his disappearance. From a drug dealers perspective Wasley was known as a mid level dealer.

Kevin Naismith- Sentenced to 33 years maximum jail time with a 25 year non parole period for first degree Murder.

Alan Faulkner- Found guilty of being an accessory after the fact and was released from jail in 2002. Less than 3 months later Faulkner became the victim in a homocide.

Basic Explanation

A mans car was found in a parking lot at a shopping centre a few suburbs across from where he lives. It was found a few hours after his wife declared him missing. Two parking spots away, another car was found belonging to another man, who was also declared missing at the same time. This leads to the search for the two owners of the vehicles, who seem to be associated in the same disappearance. After searching the two vehicles, a large quantity of cash was found which arouses suspicion that this scene may be bigger, than just a disappearance.

After the police had interviewed both Naismith and Faulkner they were both arreseted and were due to appear in court he next day. The morning of the court hearing, Faulkner called the Charlestown Police Department and said that he was willing to tell the police where the bodies were and what really happened.

Faulkner lead the police to the Stockton Dunes to a spot at the bottom of a 50m tall sand dune where he remembered both bodies had been buried and burnt. What he said happened was Naismith in the day of the fire at his garage had killed both of the victims. He killed Banks with 2 shots and brutally bashed Danny Wasley with a Baseball bat. Then that evening they drove the bodies out to the Stockton Dunes and dug a hole. While Faulkner rode around on his trike, Naismith went and bought firewood and petrol. When he returned they burnt both of he bodies and then hid further evidence in the bushland near the burial site (Keys to both mens cars). Faulkner then told police that Naismith tried to point attention away from him by creating his own fire which also destroyed some other evidence.
