Natural Law

  • The idea that there are forms of law that exist by themselves
  • Agreed on by society
  • Hugo Grotius had a strong impact on Natural Law

He published three books on Law of War and Peace:

Book 1 talks about war and natural justice, while there are circumstances where war is okay. (de jure belli)

Book 2 identifies the "just" causes of war. Those were: self defense, punishment, and the process of making amends. (jus ad bellum)

Book 3 says what rules there are in war after it started and the conduct of war. (jus in bello)

  • He entered the University of Leiden when he was 11
  • Extremely gifted and considered a prodigy
  • Published his first book at age 16
  • Involved in Dutch Politics
  • He married Maria van Reigersberch
  • Worked in more Dutch politics
  • Died on August 28, 1645 in Germany

Been named the Father of International Law

  • De Jure Belli ac Pacis (On the Law of War and Peace)
  • He wanted to minimize wars and violence
  • This regulated wars in Europe
  • Believed that only 0nly "just war" should be allowed.
  • Specifies conditions for going to war and how war should be fought

International Law

"The body of law that governs relations between or among states or nations"

To qualify as subject under international law;

a state has to be soviergn, it needs a territory, a population, a government and the ability to engage in diplomatic or foreign relations.

International Law is the law that is used when there is a conflict between countries. It is a set of treaties.
