During the American Revolution, the state of Virginia enacted legislation that allowed it to confiscate loyalsists property. Way back when, a fellow named Lord Fairfax gave his lands to his nephew Denny Martin. Virginia took some of the lands and gave it to David Hunter. Martin sued, saying that Virginia had no right to take the land just because it belonged to a British loyalist. The district court ruled for Martin while Virginia’s Court of Appeals ruled for Hunter. It then went to the Supreme Court.
The case began on March 12, 1816.The Supreme Court ruled in favor of Martin. The Virginia court of appeals unananimously voted that Hunter was the proper owner of the tract of land. The case concluded on March 20, 1816.
6 votes for Martin, 0 for Hunter. Article Three of the U.S. Constitution grants the Supreme Court jurisdiction and authority over state courts on matters involving federal law.

Virginia was claiming that the state of Virginia and the national goverment were equal sovereigns. Justice Story used the Constitution to prove the Court had the power to override state courts. It was the first case that allowed the Supreme Court to assert its authority over state courts in a matter of federal law.
Neither group could decide on a choice. One group thought the land belonged to Martin while the other group thought the land belonged to Hunter.
