Consequences

Presidency Checks

  • The system of checks and balances can slow change and encourages compromise
  • The system means that three branches are not completely independent from each other
  • Nominates federal judges
  • Can refuse to enforce the Court's decisions
  • Can grant pardons
  • Proposes laws & veto congressional legislation
  • Makes treaties, executive agreements, & executive orders
  • Can refuse to enforce congressional legislation (and has)
  • Can call special sessions of Congress

Congress Checks

  • Can override a a presidential veto
  • Can impeach the president
  • The Senate has to confirm presidential appointments
  • **Congress has the power of the purse**

Checks and Balances

Why do we need them?

  • The Constitution seperates power into 3 branches where each branch has some type of "check" on the other 2 branches
  • This doesn't allow for one branch to become supreme over the others, or in other words, doesn't allow one branch to dominate the system
  • Can rewrite legislation to circumvent the Court's decisions
  • Senate confirms federal judges & the number of judges

Judiciary Checks

  • Can declare congressional laws unconstitutional
  • Can declare presidentail actions unconstitutional
