The Supreme Court Decision

The Supreme Court ruled 9 - 0 in favor or ACLU.

Chief Justice Renquist and Justice O'Connor concurred with the rest of the court and together wrote a dissenting opinion

The court held that Internet content has full First Amendment protection.

The court also held that the First Amendment does not protect obscene material on the Internet or in any medium.

Reno v. ACLU

Congress passed the Communications Decency Act (CDA) in 1996. It was a provision of the Telecommunications Act to prohibit the use of the Internet to transmit indecent, partially offensive, or obscene material to minors.

Future Implications

The American Civil Liberties Union believed that the CDA was unconstitutional and that the government should not be allowed to regulate the Internet.
