Introduction

What is Racial Discrimination?

  • Racial discrimination is when a person is treated less favourably than another person in a similar situation because of their race colour, descent, national or ethnic origin or immigrant status (Australian Human Rights Commission, 2012).

When was the act brought in?

  • It was introduced in 1975 by the Australian Government despite the fact that it should have been brought in far earlier.

Major Objectives achieved from this act:

  • Brought equality into the system.
  • Gave everyone a fair go.
  • Gave all Australian citizens the right to do normal everyday activities, like housing, community sports, voting etc.

What influenced change?

The Aboriginal Freedom Rides in 1965 was started by a group of University students from the University of Sydney with the leader of the group being Charles Perkins. Charles Perkins was the first Aboriginal man to graduate from University. Charles then moved onto building a group of students to help with the issue. From then on they worked on drawing public attention to the health and education of the Aboriginals. They also worked on trying to get people to stop racially abusing them. The group went around from state to state interviewing people and seeing their opinions on the discrimination. Once they had gone to enough places the government had their opinion on it and they also agreed with it. The Freedom ride was one of the main reasons why the law was changed.

Why was it brought in?

  • Section 18.C had been in the headlines for quite a bit, as it was being considered of being repealed (removal of law) as the government wasn't sure if to keep this part of the act in place.
  • They weren't sure to keep the freedom of speech part in it as a person cannot be racially discriminated part in the act, but they were considering with going with people being allowed to have freedom of speech.
  • People aren't sure if racial abuse should be against the law, as that seems a bit over the top as everyone has the right to freedom of speech, and people occasionally have the slip of the tongue, like Eddie McGuire on Adam Goodes, but it is usually an accident.
  • While everyone is entitled to 'freedom of speech' this act restricts that, but for a good reason I personally believe.
  • This was to be changed to people having the right to freedom of speech, but Tony Abbotts government canned it.

  • The Racial Discrimination Act was brought in to make racial discrimination/ attacks unlawful in Australia.
  • It was brought in to make people from other races have equal rights, and to have the same right as all other Australians

Racial discrimination to be unlawful

(1) It is unlawful for a person to do any act involving a distinction, exclusion, restriction or preference based on race, colour, descent or national or ethnic origin which has the purpose or effect of nullifying or impairing the recognition, enjoyment or exercise, on an equal footing, of any human right or fundamental freedom in the political, economic, social, cultural or any other field of public life. (Racial Discrimination Act 1975, Commonwealth of Australia)

What it does for all people-

  • It helps build communities where people are jugded on who they are inside, not outside.
  • The law made it possible to bring this vision into our country.
  • It influences change in Australia to make it feel like an accepting type of country.
  • It made this country a nice place to be for everyone of all races, we are now a very multicultural country.
  • Better rights when it comes to work, housing, health care, education, access to public services and many more.
  • The Australian Parliament has the ability to suspend the RDA at any time.
  • Since 1975, thousands of individuals and organisations have used the RDA to address racism, either by making complaints or negotiating policy changes.
  • The Racial Discrimination Act was Australia’s first federal anti-discrimination law and applies throughout Australia to all people regardless of their age or where they live.
  • Each of the states and territories has adopted legislation similar to the RDA.
  • The Racial Discrimination Act was brought in by the Whitlam Government.

Through conciliation the company agreed to pay the man financial compensation and they also arranged an anti-discrimination training session for the staff.

A Maori man was working in a company and was being called rude words like ‘nigger’ and ‘black’. He made a complaint and his co-workers did not want to work with him anymore, he was then downgraded into a casual worker.

The complaint was soon resolved with an agreement which said that the organisation would provide the woman with a statement of regret and which also gave her financial compensation. They also agreed that all of the staff would take courses on anti-discrimination.

The law has had a big impact on today’s society. Although people still get racially abused the amount of people being abused has decreased dramatically. In 1995 was when the changes in people’s behaviour really started to show as a new law was introduced which was the Racial Hatred Act. In the first year after the second law was introduced there were only 10000 complaints. In the years before there were a lot more complaints which had been received. From the 10000 complaints only 3000 of them were from Australia and the rest were from other places around the world.

A woman from El Salvador said that she was harassed by a co-worker. She was told that she was being too emotional because she was from another country. The woman made a complaint and her job was made redundant. The organisation was aware of this but did not do anything about it because of her background.

The company soon agreed that they would change the locks back and let him stay in the house. The company also gave the man financial compensation and the staff had to take courses on anti-discrimination.

A Kenyan man was told by his real estate company that he had to move from the premises. He said that he had negotiated with them but they changed their mind because of his culture. The company changed his locks with all of his items in the house without telling him. He was also being racially abused by the company.
