the Judiciary Act was claimed Unconstitutional for breaking the Amendment, and this was the first time a law had been shut down for being unconstitutional!!

John Marshall reviewed both sides and in the end decided that the Judiciary Act was breaking an article of the Constitution. Marbury's appointment was never delivered.

Chief Justice, John Marshall over viewed the case, taking a look at both Madison's and Marbury's side.

John Adams did not send the appointment in time, and when his time as president was up, it was never sent out. When Jefferson took office, he told Madison not to send or recognize the appointment as it was not done when it should of been and it was a sign of wanting to be noticed.

Marbury decided he wanted to sue Madison because he wanted his commission to be delivered, so he took the case to the Supreme Court.

At the very end of his term as president, John Adams made multiple Federalist appointments, one making William Marbury the justice of the peace in District Columbia.
