SYSTEM OF CIVIL LAW

Civil law, or continental law, is the dominant system of law in the world, with its origins in Roman law, and sets out a  system of rules, usually codified, that are applied and interpreted by judges.

DEFINITION

SYSTEM OF CIVIL LAW

As a body of laws comprising the official legal system of a nation or state, especially in reference to the rights and privileges of private citizens, civil law becomes the necessary law in which freedom and necessity are unified.

HISTORY

The civil law is based on Roman law, especially the Corpus Juris Civilis of Emperor Justinian, as later developed through the Middle Ages by medieval legal scholars.

Roman law continued without break in the Byzantine Empire until its final fall in the 15th century.

Given the multiple incursions* and occupations, its laws became widely implemented in the West.

It spread in Europe mainly because its students were the only trained lawyers.

Roman law was a secondary source that was applied only when local customs and laws were found lacking* on a certain subject.

Local law came to be interpreted and evaluated primarily on the basis of Roman law, since it was a common European legal tradition of sorts, and in turn influenced the main source of law.

The work of commentators led* to the development of a common body of law and writing about law, a common legal language, and a common method of teaching and scholarship, all called the ius commune, or law common to Europe, which consolidated canon law and Roman law, and to some extent, feudal law.
