Trade Secrets

Right of Publicity

Pros

  • Patents and trademarks aren't very costly

  • All Registered are backed Federally

  • All follow a "first come, first served" mentality

  • Have not found any idea that resembles this one (with exceptions)

  • Wizards of the Coast seems to be a fan of "fair use"

Patent Example:

Cons

  • Winners of cases of "fair use" are usually determined by the skill of the lawyer

  • Wizards of the Coast are known to be "sue happy"

  • Copyright law pertains to tangible material only

  • Patent would pertain to code only (in this particular case)

  • Trademark would have to be done with loads of research in mind

Opinion

This is doable even when considering the roadblocks ahead

Building Blocks

Method of creation will determine the expectation of the output

Programming may not be required, but it is very heavily suggested

Learning programming is a good way to cut costs and have a more intricate understanding of our final product

This kind of project will likely see success either as a software or video game

Output

Output

More experience in video game designing

Outside information available for software development

Outreach and outsourcing might be a necessity

Input

Dedicating a lot of time to learning and practice

Having a student mindset

Holding each other accountable (don't let each other give up so easily)

Patience makes desirable results

Market

Publicity is key

Gamers are the future

Market

Social Media

Pros

Relatively inexpensive marketing tool

Easy to get hype up

Easy to send participants to other social media and crowdfunding sites

Social Media

Cons

Hype train windows are small

Able to get blammed from sites without constant updates

Photos, doxing, stalking

Prototype

1) Must be made before any legal action can protect it

2) Can't market without prototype

3) Without a demo, there is nothing to play or use

Videogame ESRB

Most internet laws for gaming are written in California

Based upon research, the ESRB committee consist of mostly single, divorced, and stay-at-home mothers living in wealth. This leads to unnecessarily biased results and ratings

The good news is that internet laws are now more effective than ever before

VideoGame ESRB

Social Platform

Main selling point

Selling as content creation tool in addition to being a game

Toolmaker laws might be able to protect against the ESRB

Photoshop lawsuit

High Budget Animation

Half of popular games use high-budget animation as one of their main marketing tools

Not as costly or intimidating as it might be perceived.

Funding is possible through crowd funding

Programming

Programming

Lessons on Youtube (freecodecamp)

Python most recommended for beginners

C++ and Javascript is one of the most popular as of present

Unity vs. Unreal Engine

Software Engineer can be a great asset

Legality

Part One:

  • Heavy research on "Fair Use" (find out what is in play)

Part Two:

  • Avoiding litigation as much as possible

Art Assets

Will be determined and implemented after a majority baseline of programming is mostly complete

Blender and ZBrush is what I recommend. Blender is free, Z Brush is very fluid and flexible. Both are very user-friendly.

Pixel Art is popular and attractive as an art form, especially for video games, but not personally recommended due to too many similarities of Stardew Valley and Minecraft.

Will be discussed more in detail on a later date.
