Just what is FERPA?
Federal law that protects the privacy of student education records
U.S. Department of Education, 2018
(20 U.S.C. § 1232g; 34 CFR Part 99)
The law is very clear in regards to protecting a student’s privacy in regards to educational
records.
Schools must notify parents and eligible students annually of their rights under FERPA.
However, the actual format for delivery is left to the discretion of the school.
some options include
- specific letter
- PTA bulletin
- school newspaper
- orientation manual
Student Information is compiled within a directory
including
- student's name
- address
- telephone number
- date and place of birth
- honors and awards
- dates of attendance
The school is mandated to
inform the parent/student of the directory information and there is protocol for those not wishing
this information released.
FERPA gives the parents certain rights to their students privacy, with these rights transferring to
the student upon their reaching the age of 18. There is a caveat included in that explanation that
specifically identifies the age of 18 or attends a school beyond the high school level. (U.S. Department of Education, 2018)
