But who is really to blame?
Jeffrey Hall was a plumber in California who was shot in his sleep with his own gun on May 1, 2011. Friends of the victim claimed he was a very devoted father...
The killer was his 10-year-old son Joseph.
Joseph Hall was 10 years old, and suffered some developmental difficulties due to his mother's consumption of alcohol and other drugs during while he was in utero. He also had below average intelligence and was believed to have ADHD and other issues.
He had been kicked out of 9 different schools for his violent and impulsive behavior toward students and teachers, and was at the time being homeschooled as a result, including stabbing students with pencils, and once attempting to strangle a teacher with a telephone cord.
Shortly before the incedent, Joseph had been taught by his father how to use the gun.
At 4:00 AM on the 1st of May, Joseph took his father's handgun, went to where his father was asleep on the couch, and shot him in the head.
And the Evidence
The Prosectution claimed that because CPS couldn't prove abuse, it wasn't present, and that Joseph was aware of the wrongness of his actions.
The Defence claimed that it was self defence.
Joseph was found guilty of second degree murder and in 2013
