Effectiveness of Legally Mandated Treatment

Within Substance Abuse

By: Makenna Clark-Johnson

What is legally mandated treatment

Background

-Legally Mandated treatment is when the courts order someone struggling with substance issues into something like rehab or therapy

-There is an on going debate on if this is an efficent way of treating substance abuse disorder

-One side argues, that legally mandating treatment helps get indivuduals help they need in a timely manner

-The other side argues that legally mandated treatment may diminish the theraputic relationship, making it hard for the treatment to actually work

Involuntary Commitment

(Recovery,2020)

The Argument For Legally Mandated Treatment

Side A

- Gets the people who need help the treatment that they need

-Clients don't have to wait for extended amounts of time to get said help

(Klag et al., 2009)

-Being legally mandated to go get treatment makes sure clients return to treatment (Klag et al., 2009)

Argument Against Legally Mandated Treatment

Side B

- The people who are legally mandated to recieve treatment are taking spots from people who are trying to get help on their own

- Creates a dual-realtionship between therapist and client (Hachtel et al., 2019)

- The theraputic relationship between client and therapist and client might be hindered making effective recovery harder to achieve

(Hachtel et al., 2019)

-Dual-relationships often end up crossing ethical boundaries

What I Learned

Conclusion

-Legally Mandated Substance abuse is a viable treatment option

-There is no real downside to being legally mandated for treatment (Hachtel et al., 2019)

-The real conversation should be about having more access to treatment

-Treatment is expenisve which is why so many people aren't getting it unless they are legally mandated to do so (NCDAS,2022)

Recommendations

Recommendations

- Make Treatment more affordable by:

-Electing Officals who want to help get people the treatment they need

-Holding Treatment centers accountable for thier high prices by bringing awareness to it

- Destigmatize the feelings around getting treatment through:

-Offering support to those you may know that are struggling with substance abuse

( Panchal et al., 2021)
