MEYER V STATE OF NEBRASKA
The supreme court voided Nebraska law banning the teaching of foreign languages to students other than English. Robert T. Meyer was convicted under this law because he taught German in a Parochial school.
WHO?
- Meyer was teaching German but the state of Nebraska.
- Justice James C. McReynolds delivered the majority opinion in 1923 for the Meyer vs Nebraska case.
What happened with Meyer vs the state of Nebraska 1923 ?
Robert T. Meyer was arrested for teaching German in Hamilton County. Meyer was a teacher at Zion Parochial school. The state of Nebraska wanted grade schools to ONLY teach English for both private and public schools.
Are there other cases similar?
- There were serval cases that were similar to the Meyer VS State of Nebraska case. For example, in 1925 there was the Gitlow V. New York case, where the first amendment was also being violated.
- The Meyer case indicated that many people’s first amendment had been debased since they were forced to learn in only English.
Have other states had an “English-only” law?

- Different states have adopted the English only law which leaves many children whose first language is not English.
- Massachusetts and California also had the English only law, but they have repealed their versions.
- Arizona had passed the English only education law and is still following it, which makes it difficult for students whose first language is not English.
Affects on bilingual education:
- In the first U.S. supreme court case to speak about foreign language teaching in American education the justices rejected the Nebraska law that prohibited the teaching in any other language but English
- The Nebraska Law wanted to Americanize the children of immigrants and only wanted them to learn in English till they were in the 8th grade they could learn in their other language.

- The court declared the Nebraska law unconstitutional.
- It gave the right to an educator to teach in German to a student if the parents so desired since a parent can control their children’s education.
