Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA)

Michael Goldstein and Ryan Kohn Ms. Susil Pd.4

A

Years FIFRA were drafted/amended

The Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) was first passed in 1947.

In 1972, FIFRA was then revised and amended by the Federal Environmental Pesticide Control Act as well as the Pesticide Registration Improvement Act in 2003, making it a national law.

B

Function of FIFRA

Since 1947, many revisions and changes within FIFRA have been made in order to protect citizens within the United States. Currently, the main purpose and responsibility that FIFRA enforces is the regulation of the use and sale of pesticides to protect human health and preserve the environment by the EPA and State Government. Poisoning in toxic chemicals in pesticides that may harm humans and the environment in which surroundings can decay are the key focuses of protection this act holds.

Group Responsible for Regulation and Enforcement

C

The EPA is given authority by the FIFRA to regulate the registration, distribution, sale and use of pesticides. States are also given authority to monitor and enforce the use of pesticides. States can judge whether the pesticides are used within the code of law.

The maximum criminal penalty that can be given for a violation of FIFRA is a fine of $50,000 and/or one year in prison. Meanwhile the maximum criminal penalty for commercial

use is $25,000 and/or one year in prison.

Events Leading to The Creation of FIFRA

D

Prior to the creation of FIFRA an act called the Pure Food and Drug Act passed in 1906. Also there was an act called the Federal Insecticide Act of 1910. That act was helpful to regulate the use of pesticides. Therefore the USDA, farmgroups, and chemical manufacturers came up with FIFRA with the intention of having pesticide manufacturers register their chemicals with the USDA. Another reason FIFRA was made was to get companies to label contents and directions of proper use on the products.

Controversies Surrounding FIFRA

E

The controversial facts about FIFRA and the use of pesticides is that some argue that human health is being affected as well as in some animals. Due to the harm of these two factors farmers costs are driving up to harvest. People are also pleading the federal agencies to pay more attention than normal on health-risks caused by long term exposure to pesticides.
