Amending Constitutions
Ohio is one of the states who allow their citizens to amend their constitution using Ballot Initiatives. While the process is long and complex it never the less exists.
What is a benefit of this for the citizens of the state?
- All states allow their legislators to propose amendments that are then voted on by the citizens, unless you’re in Delaware.
- Some states allow citizens to propose amendments through Ballot Initiatives.

Ohio's Constitution was rewritten in 1850 to solve some of the issues they state was experiencing under the original constitution on 1803. One of those changes added the power to create "lower" courts, as originally Ohio only had a State Supreme Court.
What would be a logical reason for this change?
- Each State has minor, trial, and appellate courts
- Minor: minor violations and private disputes as well as issuing licenses.
- Trial: various types of private and criminal cases
- Appellate: reviews decisions of lower courts
- Each state has a Supreme Court which interprets the state’s constitution and laws.
- State Legislatures pass a variety of laws
- Health, crime, labor, education, and transportation.
- Legislatures can also tax, borrow, and spend money
- 49 states have an upper and lower house, Nebraska has a unicameral legislature
The Legislative Branches of States are responsible for creating laws and policies that cover a much wider set of topics that than the Federal Government.
What is the reason for this?
The Executive Branch
President Trump left it up to the states and their governors to handle pubic safety in relation to the Corona Virus.
What is a benefit for doing this state by state? What is a drawback?
- Every State has a Governor who can execute, sign, and propose laws.
- In most states the governor, lieutenant governor, attorney general, and secretary of state are each elected and do separate jobs.
- Governors also work to secure grants from the Federal Government for schools, highways and urban areas.
- Also, they coordinate with other states for transportation and pollution control; as well as other countries to get production moved to their state
