University of California, Davis vs. Allan Bakke

Thursday, October 12, 1978

50¢

Vol XCIII, No. 311

438 U.S. 256

Background

"The University of California had two very different admissions programs- the regular admissions and the special admissions.

Allan vs. The University of California

The school had before reserved 16 spots in each class for 100 minority students who met the univerity's standards.

"The University of California at Davis is a public medical college that was founded in 1907 and is ranked as one of the Best Colleges in the United States" ("University of California-Davis").

"Allan Bakke was a veteran who was twice rejected from the University for unknown reasons although his grades and his attitude were more than magnificent" ("Bakke Allan Paul").

This was part of the university's affirmative action* program which was made to help people in minority groups get into medical school.

A young veteran named Allan Bakke applied for both admissions and was rejected from both although we had amazing grades and was quite intelligent. This made Allan along with a few other people very angry and led them to protest" ("University of California").

*Affirmative Action - Admission policies that provide equal access to education for those groups that have be historically excluded such as women and minority members

Final Decision

Conclusion

"The Court held a closely divided decision that race could be one of the factors considered in choosing a divers student body in university admissions decisions. The Court also held however, that the use of quotas in such affirmative action programs was not permissible: thus the Univ. of California...discriminated against Bakke... As a result of the decision, Bakke was admitted to the medical school and graduated in 1982" ("Regimens of the University").

"The University of California vs. Allan Bakke court case had a great impact on the world. I say this because this case changed the minds of many. The Court made a simply unfair decision. People who wouldn't usually be accepted due to their skin tone or because of their sex now had a smaller chance because of Bakke. This case is important and had a very strong impact because this case showed that not only do you have to work hard for your things, but you also have to fight for what you believe is right which is what Bakke did one way or another" ("University of California vs. Allan Bakke").
