Who v. Who

403 U.S. 713 (1971)

Important factor of case

403 U.S. 713

Case citation 403 U.S. 713 was a court case that was a landmark decision made by the U.. Supreme Court on the first amendment. The ruling allowed the New York Times to publish the then classified Pentagon Papers without any federal censorship or punishment.

The United States government sought a restraining order that barred the New York Times from publishing any further articles based upon the Pentagon Papers because they felt it would cause "irreparable injury to the defense interest of the United States"

The New York Times agreed to abide by the restraining order and on June 19, the District court rejected the administration's request for an injunction, whereas the court of appeals after an en banc hearing, granted an injunction until June 25. The District court of the District of Columbia rejected the government's request. this inconsistency led to the Supreme Court to hear the case.

This case involved the newspaper company The New York Times and the United States government. The United states did not want to have their secrets out in the open for public access. While the United States government did not want their secrets out, the newspaper company was only trying to do their job in informing the people about what is going on in the lives they are living, but the U.S. government was preventing them from doing their job.
