Special Education Identification Process

The Steps of the Identification Process

1. The Professionals Involved:

The teacher, the special education supervisor, the social worker, the psychologist, the parents, the principal, any other school staff that works with the child, health care professionals.

Role as a teacher: It is my responsibly to contact parents, and refer any child suspected of not developing educationally as the other students at the same grade level. Also to follow IEP goals and inform parents for consent with any changes made.

What assessments are used and how do I interpret the results?

Assessments used are student work samples and test scores, Universal benchmark testing through the district, observations,and National grade level assessments.

Does my school or district have a pre-referral procedure?

The Individuals with Disabilities Education Act (IDEA) is a four part (A-D) piece of legislation that ensures students with a disability are provided with a Free Appropriate Public Education (FAPE) that is tailored to their individual needs. This Act was signed in 1975 before that children with disabilites were excluded from public education. Since this Act was created there have been numerous adjustments made to it such as NCLB, allowing students with disabilities a least restrictive environment with assessments and goals to ensure a meaningful eduation for them.

Section 504 is a federal law designed to protect the rights of individuals with disabilities in programs and activities that receive Federal financial assistance from the U.S. Department of Education (ED). Section 504 provides: "No otherwise qualified individual with a disability in the United States . . . shall, solely by reason of her or his disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance . . . ." This law regulates the type and amount of funding a school receives depending on their compliance with the law.

The district has many head start programs. They participate in "Child Find" activities for early intervention. A child may be identified as having a disability through these activities. If a child is suspected of having a disability the parents may be asked if the school can evaluate their child. Parents can also ask that their child be evaluated. The state must identify, locate, and evaluate all children with disabilities who need special education and related services.

What is the process in my school and district for addressing concerns?

1. How do I identify students in my classroom who may be in need of services?

A referral or request for evaluation is started if a teacher is concerned that a student might need to be evaluated. Parents can contact the child's teacher or other school professional such as the special education supervisor or psychologist to ask that their child be evaluated. The request from the teacher or parent can be verbal or in writing. Parental consent is needed before the child may be evaluated. Evaluation needs to be completed within a reasonable time after the parent gives consent.
