Food Lion vs ABC
ABC's Primetime Live is tipped off about unsanitary practices at Food Lion grocery stores.
Supreme Court Ruling
A federal jury in Greensboro, North Carolina slammed ABC News with a $5.5 million judgment.
Tainted meat was apparently being sold, along with
products past their due dates.
Dirty cutting and packaging equipment was allegedly
being used as well.
Finally
Corporate misconduct should be
exposed but journalists must make
ethical decisions to uncover the story.
Food Lion Fights Back
The broadcast included, for example, videotape that appeared to show Food Lion employees repackaging and redating fish that had passed the expiration date, grinding expired beef with fresh beef, and applying barbeque sauce to chicken past its expiration date in order to mask the smell and sell it as fresh in the gourmet food section. The program included statements by former Food Lion employees alleging even more serious mishandling of meat at Food Lion stores in several states.
Food Lion sues ABC, but did not sue for defamation, they focused on how ABC gathered its information through claims for fraud, breach of duty, breach of loyalty, trespassing, and unfair trade practices (because the "employees lied on their applications for hire).
Food Lion ran a TV special of their own that detailed how sanitary their conditions are and exposed the decrepencies with ABC's report. They showed outtakes that include what seemed to be ABC setting up some of the dirty conditions, as well as a biased attitude against Food Lion. (There's that BIAS word again!!)
What happened?
Producers applied for job at Food Lion with fake resumes and manufactured references.
Used hidden cameras to get footage of the different transgressions being committed.
Edited film and present it in a way that wasn't entirely true to actual events.
