TYPES OF PRISON
There were two different prison systems England:
- The prison hulks
- House of correction
- It was a common punishment .
- During 18th century, the number of crimes that were punished by hanging rose to about 200.
- The dead sentence could be passed for picking pockets or stealing food
IMPRISOMENT
TRANSPORTATION AND PENAL SERVITUDE
Until the late 18th century it was unusual to imprison guilty for long terms.
By the Victorian era it had become the main form of punishment for a wide range of offences.
- It was based on sent convicted criminals to serve their sentence.
- Later in the Victorian Period this was replaced with penal servitude.
- Penal servitude means serving a sentence that is meant to punish the prisoners.
The Court System
TYPES OF PUNISHMENT
HARD LABOUR
- The 19th century justice system consisted of two courts, the Sherrif Court and the High Court .
- The most common crimes to be tried in the Sherrif Court were theft and assault.
- More difficult cases were referred to the High Court .
- Prisoners were often used as the main work force in quarrying, building roads or laboring on the docks
- Transportation and penal servitude
- Hanging
- Imprisonment
- Hard Labor
- Physical punishment
- Sending to the Armed Forces
- Fines
PHYSICAL PUNISHMENT
- Most forms of physical punishment had died out by this time and were seen as barbaric.
SENDING TO THE ARMED FORCES
- In time of war it was often difficult to recruit people to the Armed Forces.
FINES
JUSTICE AND PUNISHMENT IN 18th CENTURY ENGLAND
- This wasn't in common use.
- Imprisonment or hard labor clearly showed that the criminals had been properly punished as did a spell in a "reformatory" for young offenders.
