Anti-Gay activists started to get a little antsy

They campaigned to have laws banning gay marriage.

1995!

Utah jumped on the bandwagon and began to create laws removing all sorts of pro-gay rights.

Congress!

The world of US politics became a hostile place for pro-gay activists.

1996!

Congress made DOMA a bill in May.

1!

Stephen Gunderson was the only republican to oppose the DOMA.

He was not reelected in the election of 1996.`

And here's where the controversy begins....

Bill Clinton signed the bill September 21, 1996.

But he had advertised himself as "pro-gay"

The Real

Question is:

Can you really be considered pro-gay if you

  • don't help the LGBT community like you promised in your campaigns?
  • you sign into law an anti-gay law?

2004!

The DOMA was vulnerable under the Full Faith and credit Clause.

He amended the DOMA to fully protect marriage while leaving states free to make their own choices in terms of same-sex marriage

Finally a change!

Obama wanted to repeal "Don't Ask, Don't Tell"

And unlike Clinton, he got that done.

When Obama got the call for action...

He answered immediately.

Obama basically told the Justice Department they were no longer allowed to defend the law's constitutionality. But they can still enforce it.

  • Minority Leader Nancy Pelosi
  • Minority Whip Steny Hoyer

Nancy, however, commends Obama for not supporting the law and critizes Boehner for creating this advisory.

Way to git-er-done!

The last thing Obama told Boehner was if they wanted to enforce the law they could foot the bill.

Gill v. Office Personnel

  • ruled section 3 of DOMA unconstitutional
  • violates the "Equal Protection" given by the 5th amendment
  • takes away the health and retirement benefits of same-sex couples

Judge Joseph Tauro ruled the DOMA violates constitutional principles of equal protection and sending clause of constitution.
