  1. So the first type of parish modification that the congregation
  2. for clergy identified in its 2013 letter was this extinct
  3. of union of parishes, what is generically called mergers, that
  4. situation of parish a parish be uniting to form Paris
  5. C and only Paris C remains.
  6. There is no suppression going on here.
  7. So in other words, no cannon 123 suppressions going on.
  8. Uh, and therefore none of the things dealing with suppressions
  9. is going on.
  10. We're under a merger situation can and 121 and not
  11. a suppression.
  12. The second way, second modification that the, the, the Vatican
  13. identified was this extinct of union of parishes called Amalgam
  14. Ations instead, and it's practically the same as the other
  15. one. Except it's a clear a little bit of a
  16. distinction here and this is more of an amalgamation.
  17. So perish A is subsumed under parish be, and Parish
  18. B is the only thing that remains.
  19. So, once again, this is not strictly a suppression.
  20. This is not actually a suppression at all.
  21. But it's not strictly a 1 21 merger either.
  22. Because you don't have just two entities coming together together
  23. to form a new entity.
  24. But you do have a merger.
  25. It's an amalgamation where one entity is subsumed by the
  26. other one and that other entity Parish be still remains
  27. the Vatican and saying, well, this is not strictly a
  28. merger, But it is a 121 merger.
  29. It's it's not, you know, to that that that that
  30. that situation, one that we looked at.
  31. However, it is clear that this is still a merger.
  32. You cannot treat Parish A as suppressed in other words,
  33. Parish A is not a suppression of what happened here.
  34. Was a merger?
  35. An amalgamation merger?
  36. Yes, but a merger nonetheless, it's not a suppression of
  37. Parish A.
  38. Because it's been joined to amalgamated to perish be And
  39. therefore we have to use the norms for murdering what
  40. can 121 as opposed to suppression of of of of
  41. of parish a under 21 23.
  42. A very very good distinction.
  43. Once again that the Vatican is making The 3rd type
  44. of action that the Vatican identified it labelled as total
  45. division. Total division is when you have one Parish, Parish
  46. A. And Parish A.
  47. Then is divided into Parish B and paris C.
  48. So that only parish B and parish see remains.
  49. Once again, here you do not have a suppression.
  50. What's going on is a total division.
  51. A division where you have one entity that's now split
  52. into two.
  53. That original entity does not exist but it is not
  54. suppressed, it's been divided.
  55. And so once this division has happened, We Go Under
  56. Canon 1 22.
  57. Once again, there's no suppression of Parish A.
  58. So none of that applies, particularly when it comes to
  59. the temporal goods.
  60. Again, another very, very good distinction.
  61. So, we have the first type, which is the merger
  62. where we have perish Perish be, they unite so that
  63. only paris C remains in the second, the amalgamation you
  64. have Parish A Parish be, and then Parish is subsumed
  65. under parish be said that only Parish Be remains.
  66. That too is not a suppression in any way it's
  67. a merger, but a merger in the in the form
  68. of an amalgamation when it's taken to the other one
  69. over no suppression, The 3rd 1 is a total division
  70. where you have parish, a parish is divided to perish
  71. be and Paris C.
  72. So that parish a no longer exists, but only parish
  73. B&C. Paris is not suppressed.
  74. However, it's been divided.
  75. So we're under 10 1 22 and its requirements not
  76. under Can 1 23 of suppression?
  77. The 4th way that it identified.
  78. The fourth thing that it identified is a suppression suppression
  79. is when you have parish a Parish A is extinguished
  80. is suppressed.
  81. Nothing remains.
  82. This now is properly called the extinction of Canon 123.
  83. Sometimes known as a closure.
  84. But we'll look more closely at that that in the
  85. next module.
  86. But this the more proper term is actually extinction.
  87. It's extinguished.
  88. Not not amalgamated, not merged, It's extinguished is suppressed.
  89. Notice What's going on here, the Vatican saying, look out
  90. of all these four.
  91. Only scenario four is a true suppression.
  92. You cannot treat scenarios 1, 2 and three as a
  93. suppression as an extinction of any of those entities.
  94. They've been amalgamated.
  95. They've been merged.
  96. They've been been divided yes.
  97. Under those other models.
  98. But nothing has been suppressed in those models.
  99. Only under four.
  100. Now. Only under this situation.
  101. Do you have a true suppression?
  102. A true distinction that is going on.
  103. So therefore you cannot use the cannons and the steps
  104. and the rights and duties of a suppression for that.
  105. Okay, There are then principles that the Vatican's letter laid
  106. out and the Vatican's letter, by the way, it's in
  107. the readings.
  108. I I posted it up as one of the readings.
  109. You should have read it already.
  110. If not, I really suggest going and and reading it.
  111. Uh, and we're just kind of walking through some of
  112. the main points here.
  113. The Vatican then gave the congregational clergy, gave principles for
  114. parish modifications.
  115. Any type of parish modifications.
  116. And it reminded us of that Cannon 5 15, Section
  117. two, that it's the diocesan bishop who is the competent
  118. authority to erect to suppress to alter, perishes.
  119. It speaks about territorial parishes since they are communities of
  120. the faithful as a general rule can only be united
  121. or divided.
  122. What's he getting at there?
  123. It's getting at look if something is a juristic person,
  124. perish as a juristic person.
  125. Remember the presumption is that it has perpetual existence.
  126. Remember that when we talked about the establishment of juristic
  127. persons and things like that.
  128. One of the Presumptions is that it has perpetual existence
  129. and we look at the time where it can be
  130. suppressed when we get to suppression, but the presumption is
  131. thus so if that's the presumption, then our movement should
  132. be uniting it with something or dividing it, meaning merging
  133. and division and things like that, not necessarily suppression, because
  134. that's an unusual circumstance.
  135. That's something that's not normally envisioned for a public juristic
  136. person. Personal parishes, however, ordinarily are united or divided either
  137. to another personal or territorial parish, though sometimes personal parishes
  138. are truly suppressed.
  139. So it's saying that, as a rule, generally speaking, we
  140. don't suppress parishes.
  141. The other ways are more preferable, and that's what we
  142. should be looking towards and not suppression suppression, though you
  143. can do it is actually an unusual circumstance.
  144. Very extraordinarily unusual circumstances because public purity persons continue.
  145. What about the reasons for modifications?
  146. Remember where we are?
  147. We're under modifications of parishes, the Vatican.
  148. Then the congregational clergy lays out the reasons for modifications
  149. of parishes.
  150. It says, this primary reason for any sort of alteration
  151. of parishes is a concern for souls and when the
  152. good of the faithful, requiring first and foremost has to
  153. be the concern of souls.
  154. In other words, when we're looking at, quote, pastoral planning,
  155. when we're looking at modification of parishes divisions, mergers.
  156. God forbid suppression some parishes, The first and foremost goal
  157. is always the salvation of Souls, the good of souls.
  158. It cannot be the financial situation of the diocese.
  159. It cannot be, although that can play into it, but
  160. that can't be the primary goal.
  161. The primary goal can't be that the demographics of change,
  162. The primary goal can't even be something like, well, we're
  163. not gonna have enough priests in 20 years.
  164. Those are factors.
  165. And though I'm not saying, I'm not belittling those and
  166. I'm not saying those can't come into play and needs
  167. to come into play as a matter of fact, but
  168. those cannot be the primary reason.
  169. We cannot change parishes, merge them, modify them anyway, simply
  170. because of, of one of those reasons, the salvation of
  171. Souls has to be the primary reason.
  172. And that's what the Vatican's reminding us extinct of unions
  173. and suppressions should be the last choice.
  174. Other remedies must at least be considered seriously first.
  175. So in any pastoral planning uh, situation, in any, any
  176. sort of study and things like that, we have to
  177. be able to show that we've explored these other ways.
  178. We have to seriously be able to show that this
  179. is just not the first thing that bishop went to
  180. because he was too lazy to to explore any other
  181. ways. That's not what we want, because it's a public
  182. already person.
  183. We want to be able to say, look, we have
  184. explored every single way and this is what we came
  185. up with for the good of souls.
  186. We don't want to be able to people to point
  187. to us to be able to say, look, the bishop
  188. was just concerned about money and he was too lazy
  189. to look at any other way of doing it.
  190. That's the Vatican says.
  191. Yeah, that's correct.
  192. We need to look at the Salvation of Souls first
  193. and then in looking at the Salvation of Souls, we
  194. have to make sure before we do suppressions before we
  195. even do these extinct of unions, these mergers and things
  196. like that.
  197. Those are the last choice is what other remedies may
  198. be out there.
  199. The good of the whole diocese, the congregation says, can
  200. be considered by the diocesan bishop, but the reasons for
  201. modifying a particular parish must be relevant to that individual
  202. parish. This is so important.
  203. In other words, the cause must be at room to
  204. the thing itself.
  205. In other words, generalized or diocesan motivations alone cannot justify
  206. the modification of a specific perish.
  207. The congregation here is being very, very clear and serious.
  208. It's saying, look, parish a here parish be if you
  209. modify them, whether it be extinct of unions, mergers, divisions
  210. or suppressions.
  211. God forbid if you do that, it cannot be for
  212. the reason of the diocese.
  213. It has to be a reason relative to that odd
  214. question to the thing itself, to the parish itself.
  215. These considerations Parish A is like this and this and
  216. this and this.
  217. Parish B is like this and this and this.
  218. In other words, Parish A should not be modified just
  219. because it happens to be part of the diocese.
  220. That's what the congregation is saying here.
  221. Reasons for modifying any specific parish has to be relevant
  222. to that individual.
  223. Perish the good of the entire diocese.
  224. Yes, that can be taken into consideration, but that cannot
  225. be the sole reason.
  226. Can't even really be the overarching reason is what I
  227. would say here.
  228. It has to be relative to that parish.
  229. What we're doing to that parish.
  230. How we're reconfiguring that perish whether it be suppression or
  231. whatever has to be for the reasons of that parish
  232. can't just be a general what the diocese can't handle
  233. it anymore.
  234. We, we, we don't have enough priests to send their,
  235. those are all diocese.
  236. And reasons.
  237. What about this parish is what the congregation is getting
  238. at. A very, very good and sobering distinction to make.
  239. What about this notion of shortage of clergy?
  240. The shortest of clergy is the diocesan reason.
  241. So it can be taken into consideration, but it cannot
  242. be the sole reason, just like any other.
  243. One reason usually doesn't suffice.
  244. It's usually for difficult.
  245. The congregation kind of kind of acknowledges for people from
  246. one parish to see that there's an issue.
  247. And that makes a lot of sense because you look
  248. at, if you were in a parish and we're connected
  249. with dialysis and politics or rumors or news or something
  250. like that, you show up and there's a priest here,
  251. it's very difficult to say, well now your parish is
  252. shut down because we don't have enough clergy.
  253. Now, that may be the case.
  254. And I think people do need to understand that a
  255. little bit more, but that being the case, the congregation
  256. is saying a lot of times, that's a shock to
  257. people. They don't understand that.
  258. So we have to be sensitive to that.
  259. Nonetheless, the shortage of clergy can't be, the only reason,
  260. can't be the overriding reason.
  261. We should seek other creative ways first before making this
  262. a reason for modification suppression, for example, what about leahy
  263. administrative help such as such as business managers?
  264. Many places are going to business managers, models and things
  265. like that.
  266. And I hope that in ecclesia administration we can reach
  267. out to those folks as well.
  268. What about deacons or lay persons appointed according to Canon
  269. 517 section to that.
  270. That that giving some sort of administrative oversight to the
  271. parish. Those are all things that are already in our
  272. economical system that could work.
  273. That could be used in order to to to to
  274. to address the situation of shortage of clergy.
  275. What the congregation is getting at is that just because
  276. we have a shortage and it's a serious shortage and
  277. it's something that has to be considered.
  278. Yes, but that's not an overriding reason.
  279. That can't be the main reason it has to be
  280. according to this parish.
  281. How does it affect this parish?
  282. What's it to add cream to this parish.
  283. And then have we explored the other ways of of
  284. of looking at it yet other solutions perhaps procedurally speaking
  285. for validity, the diocese and Bishop has to follow all
  286. the norms of law, especially regarding getting the necessary consents
  287. and consultations that's going to be independent on which action
  288. he is taking.
  289. The consultations must be quote genuine and should consider relevant
  290. arguments both for and against the proposed modification.
  291. So the congregation is very clear here that for validity.
  292. Remember, candle 1 27 to 2, the bishop really needs
  293. to get the proper consent and and and consultations.
  294. If he doesn't, it's invalid.
  295. If he isn't doesn't, then this these things still go
  296. on uh that's gonna be dependent on which which which
  297. procedure he uses.
  298. However.
