Specifying Division 01 for Design-Build Projects
General Conditions and Division 01
"Division 01 sections expand on certain of the administrative and procedural provisions in the conditions of the contract..." CSPG.
Dependent on terms of Agreement between Owner and DBE.
Sometimes dependent on specific D-B structure.
Submittal review is for design and performance compliance with Owner's design requirements versus technical compliance with contract documents.
Design-Bid-Build versus Design-Build
How do Division 01 Specifications apply to each method of Project Delivery?
Who is responsible for cost overruns?

Who thinks it's the Architect?
Have Architects gradually transferred their technical responsibilities and liability to other parties as buildings have become more complex?
What is the relationship between design and cost?
In the 1970's, the AIA changed the terms in their standard agreements to reduce architect's responsibilities during construction from "full-time oversight" to "periodic observation."
What should an Architect's responsibilities be during construction?
Who thinks it's the Contractor or Construction Manager?
Do constructors bid low in anticipation of receiving change orders to make up for their impossibly low bids?
Who thinks it's the Owner?
Do Owners make too many changes during construction?
DESIGN-BUILD
Specifications function as a risk management tool and to convey design intent.
Internal documents, not contract documents.
Submittal procedures should be specified in Agreement or General Conditions of the Contract between the Owner and Design-Builder.
Contractor is not contractually bound to comply with specifications.
TRADITIONAL DESIGN-BID-BUILD
Drawings and Specifications are contract documents and are aligned closely with Owner's requirements.
Division 01 specifies the administrative and procedural requirements necessary during construction.
Submittal procedures must be specified in Division 01.
Submittals are evaluated based on their technical compliance with contract documents.
Changes to the contract documents must be administered as modifications, e.g. change orders.
Whatever became of the apprenticeship system?
Can academia help? How have they hurt or exacerbated the problem?
Are Owner's scheduling demands unreasonable? How have they changed in recent years?
Do Owners trust constructors more than design professionals?
Do Owners provide unrealistic bugdets for over ambitious program requirements?

Section 012600 Contract Modification Procedures:
The procedures for processing Modifications applies to all changes that modify the contract documents, regardless of whether or not the contract time and cost are affected.
D-B
Section 012600 Contract Modification Procedures:
Modifications, or Change Orders, should be limited to those initiated by the Owner regarding increases to scope or revisions related to time.

Section 012900 Payment Procedures:
Must be included to establish required procedures.
Section 012900 Payment Procedures:
Should be stipulated in General Conditions or Agreement between Owner and Design-Builder; probably not required.

Section 013300 Submittal Procedures
Submittals are required to verify technical compliance with contract documents.
Must be included to establish required procedures.

Section 013300 Submittal Procedures
The purpose of submittals is only to verify design and performance comply with Owner's requirements.
Submittals may or may not include selected product information.
Procedures should be specified by contract or in conditions.

Section 014000 Quality Requirements:
Edit to suit requirements for project.
Delineate testing and inspection payed for by Constructor and Owner.
Eliminate laboratory mockups if design employs conventional, well tested components in conventional configurations.

Section 014000 Quality Requirements:
Retain controlled, or special inspections required by AHJs; delete inspections not required by regulations.
Eliminate laboratory mockups if design employs conventional, well tested components in conventional configurations.

Section 015000 Temporary Facilities and Controls
Necessary to establish administrative and procedural requirements for supplying temporary power, heat and other facilities.
D-B
Section 015000 Temporary Facilities and Controls
Most necessary in an existing facility where the Owner has restrictive requirements for using existing facilities and where existing or adjacent facilities are occupied; may not be required for new construction.
D-B-B
Section 016000 Product Requirements
Edit to suit Owner's special requirements for project, if any.
Must be included to distinguish bases-of-design from comparable products.
Materials and products installed must be in technical compliance with contract documents.
D-B
Section 016000 Product Requirements
Edit to suit Owner's special requirements for project, if any.
Single source or proprietary specifications are possible since the cost of the Work is determined prior to selecting materials and products.
Materials and products selected by Design-Builder must conform to performance requirements stipulated in the initial RFP or Preliminary Project Description (PPD).

Section 018113 Sustainable Design Requirements
Section 019113 General Commissioning Requirements
Specifying LEED submittals and Commissioning requirements will be necessary depending on the Owner's requirements.
Data gathering and filing with USGBC can be assigned to the Architect or an outside consultant.

Section 018113 Sustainable Design Requirements
Section 019113 General Commissioning Requirements
Specifying LEED submittals and Commissioning requirements will be necessary depending on the Owner's requirements.
Data gathering and filing with USGBC is the Design-Builder's responsibility unless an outside consultant is contracted to administer LEED submittals.
Do constructors propose too many substitutions?
Do constructors cut too many corners trying to reduce their costs?
Do constructors sacrifice quality to increase their profit?
Do constructors curry favor with Owners to influence decisions about cost?
