The Basics of Disability Rights

What acts: Americans with Disabilities of 1990, IDEA, ESEA/NCLB, ADAAA & Section 504 of the Rehabilitation Act, Education Funding
Time period: 1970s (judicially)
Mental and Learning Disabilities
Physical Disabilities
A physical disability is one that affects a person's motor or dexterity

Different kinds of disabilities:
Paraplegia / Quadriplegia / Hemiphlegia
Multiple sclerosis (MS)
Cerebral palsy
Absent limb/reduced limb function
Polio

During protests, disabled people would drag themselves up stairs to the courthouse
Before people understood disabilities, children with mental and learning disabilities were placed in asylums and institutions
Handicapped did not have access to schools, apartment buildings, or public transportation

Some were forcibly sterilized under state laws

1 in 5 Americans are disabled

Sight loss can be caused by disease, accidents, and congenital illnesses
Blind students can be assisted with a scribe, voice synthesizers, and braille
Impact of the Movement
Assumptions and stereotypes were not transformed in a short time period
Attempts to limit the right to have an abortion and to limit legalized assisted suicides or euthanasia
Living centers have been successful in assisting people with disabilities to live independently without oppression
More people become activists through empowered consciousness - "acting together to empower others"

Originally from Maryland
Became paralyzed at 15 while riding at the Field of Dreams motocross track in Boswell, Pa.
Races his bike with a special harness, straps and modified seat

Deafness or hearing loss can be caused by physical damage, disease during pregnancy, or exposure to very loud noises
Deaf students can interact with others through sign language, the assistance of an interpreter, and visuals
Increases efforts to improve student academic achievement and focuses attention on low-performing groups of students to close the achievement gap.
The Elementary & Secondary Education Act (ESEA) or No Child Left Behind (NCLB)
Four Principles of Education Reform
1. Stronger accountability for results;
2. Increased flexibility and local control;
3. Expanded options for parents and (4) an emphasis on teaching qualifications and methods.
Education for All Handicapped Children Act
Federal program authorizing state and local aid for special education and related services for children with disabilities.

The Individuals with Disabilities Education Act (IDEA)
Inclusion of children with disabilities into regular classes
Included the rights of parents to be involved in the educational decisions of their children
Lesson plans are made for disabled students with a goal of being similar to plans for able bodied and able minded students.

Before EHA:
1 million disabled children left with no access.

After EHA:
more than 6 million disabled children are receiving proper education.
