Family Medical Leave Act A quick reference for supervisors Eligibility Must have worked at least:
12 months
1250 hours Return to:
Same/ similar job
Same pay rate Has the employee worked at least 12 months at the City?

Have they worked at least 1250 hours in those 12 months? YES Send the intial FMLA eligibility letter and appropriate certification form to employee Does the completed certification form support the need for FMLA absence? YES Has the employee taken any FMLA leave in the past 12 months? Employee is eligible for up to 12 weeks of FMLA leave. No Yes The FMLA filing path Employee requests time off. Is it for:
birth, adoption, or foster placement?
employee's serious health condition?
serious health condition of employee's spouse, parent or minor child? (12 weeks of FMLA leave allotment)

Keep track of FMLA leave used. Absence is not FMLA qualifying.

Send denial letter to employee. Is it a military exigency? Is it to care for an injured service member? Has the employee worked at least 12 months at the City?

Have they worked at least 1250 hours in those 12 months? Send the intial FMLA eligibility letter and appropriate certification form to employee Does the completed certification form support the need for FMLA absence? Has the employee taken any FMLA leave in the past 12 months? Yes No Employee is eligible for up to 26 weeks of FMLA leave. (26 weeks of FMLA leave allotment)
