Speech that's not Protected by the First Amendment Fighting Words Fighting Words is a speech that is clear invitation to a brawl. Obscenity
The Court ruled that the speech of obscenity will not be protected by the
First Amendment
The reason for this decision was basically the fact that it could be offensive to people.
(In the case of Miller V. California in 1973)
