Who is Wilkerson?
Reasons the case was brought to the Supreme Court
The United States Supreme Court affirmed the ruling of the Supreme Court of the Territory of Utah when it decided that death by firing squad did not constitute rule and unusual punishment as prohibited by the Eighth Amendment to the United States Constitution.

Wilkerson v. Utah, 1879, is a United States Supreme Court case in which the Court confirmed the judgment of the Supreme Court of the Territory of Utah.

Wallace Wilkerson (c. 1834 – May 16, 1879)was an American stockman who was sentenced to death by the Territory of Utah for the murder of William Baxter.
This case is the key decision that allowed the government to implement the death penalty for certain crimes. Therefore, understanding this case is a must when conducting research on the constitutionality of the capital punishment.
Wilkerson claimed his innocence, but chose to die by fire squad over hanging himself or decapitation. The execution was mishandled; It took up to 27 minutes for Wilkerson to die because the firing squad missed his heart.

Which now that we do not have the death penalty but to be condemn to put to jail of whatever the criminal did.
