Employment Standards Act
Establishes the minimum standards for workplaces in Ontario (provincially regulated)
All employers must follow the ESA
Enforced through employee complaints and proactive inspections by the Ministry of Labour
Labour Relations Act
Facilitates collective bargaining between employers and trade unions, and promotes the expeditious resolution of workplace
Applies to all unionized workplaces in Ontario
Occupational Health and Safety Act
Establishes protection for and prevention of health and safety hazards on the job
Applies to most provincially regulated workplaces In Ontario
Enforced through complaints and proactive inspections
In Ontario, no specific privacy legislation that restricts/regulates an employee’s personal information in the workplace
Personal Health Information Protection Act (“PHIPA”)
Possible common law claim for invasion of privacy (“intrusion upon seclusion”)
Accessibility for Ontarians with Disabilities Act (“AODA”)
Creates accessibility standards to identify, remove, & prevent barriers for people with disabilities
Applies to all organizations across Ontario
Penalties range from $500 to $15,000
Pay Equity
Ensures employees receive equal pay for work of equal value
Applies to all employers in Ontario except for private sector employers with fewer than 10 employees
Enforced through complaints and proactive inspections
Workplace Safety and Insurance Act
Establishes a system, which compensates employees for work-related injuries and illness
Applies to most employees who are employed by a Schedule 1 or a Schedule 2 employer
Enforced through investigations and audits
